These Terms and Conditions govern your use of this website and your engagement of any service provided by Tiang Amanah. Please read them carefully before proceeding. By using this website or instructing us to act on your behalf, you agree to these terms.

We provide legal assistance for pension entitlement matters in Malaysia. Our three services and their fees are:

  1. Full Pension Entitlement Review and Representation — RM 650
  2. Appeal Against a Reduced or Refused Payment — RM 420
  3. Consultation and Document Preparation Session — RM 150

Services are available to individuals whose pension or retirement entitlement matters fall under Malaysian law, including those governed by the Employees Provident Fund Act 1991 and the Pensions Act 1980. We do not provide services for matters governed solely by the law of another jurisdiction.

We make no representation that any service will be appropriate for your specific situation until we have reviewed the relevant documents and discussed your matter with you.

4. Engagement and Scope

An engagement begins when we issue a written confirmation of the service agreed and the fee payable, and you confirm your acceptance in writing. The scope of each service is limited to what is described in that written confirmation. Any additional work required beyond the agreed scope will be discussed with you and agreed in a separate written confirmation before it is undertaken.

We will not begin collecting records from third parties on your behalf without your explicit written consent for each category of disclosure.

Fees are stated in Malaysian Ringgit (RM) and are payable in full before work begins, unless a different arrangement is stated in writing. Accepted payment methods will be confirmed at the time of engagement. No additional fee will be charged unless the scope of work is extended by mutual written agreement.

The fees listed on this website are correct at the date of publication. We reserve the right to revise fees for new engagements with reasonable notice.

7. Intellectual Property

All content on this website — including text, layout and design — is the property of Tiang Amanah and may not be reproduced without our written consent. Written advice, submissions and reports prepared for your matter are provided for your personal use in connection with that matter and may not be published or shared with third parties without our agreement, except as required by law.

8. Confidentiality

We treat all information shared with us in connection with your matter as confidential. We will not disclose any information relating to your matter to any third party without your written consent, except where required to do so by a court order, regulatory authority or applicable Malaysian law.

This obligation of confidentiality continues after the conclusion of the matter and after the termination of the agreement.

9. Honest Assessment of Prospects

Where we consider that a matter is unlikely to result in a favourable outcome, we will say so at the outset and explain our reasons. The decision to proceed with any service rests entirely with you. We do not make any representation regarding the likelihood of a specific outcome in your matter, and nothing on this website should be read as such a representation.

10. Limitation of Liability

To the extent permitted by Malaysian law, our liability to you in connection with any service is limited to the fee paid for that service. We are not liable for any indirect, consequential or economic loss arising from the provision or non-provision of a service, including any decision made by a pension authority, tribunal or court.

Nothing in these terms limits our liability for fraud, wilful misconduct or any liability that cannot be excluded by law.

Either party may end the engagement by giving written notice. If you choose to end the engagement after work has begun, you remain responsible for the agreed fee in full unless a different arrangement is stated in writing. We reserve the right to cease acting if we receive information that materially changes the nature of the matter, or if you do not provide information or instructions within a reasonable time after being asked.

12. Dispute Resolution

We prefer to resolve any concerns informally. If you have a concern about our services, please contact us at [email protected] in the first instance. We will acknowledge your concern within five working days and aim to respond fully within twenty-one days.

If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Malaysia. These Terms and Conditions are governed by the laws of Malaysia.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. The "Last Updated" date at the top of this page will be revised accordingly. Changes will not affect engagements that are already confirmed in writing at the time of the change.

14. Severability

If any provision of these Terms and Conditions is found to be unenforceable under Malaysian law, the remaining provisions will continue in full force and effect.
